Omara is a wellness platform operated by Melius Wellness LLC. We focus on education, eligibility screening, and non-clinical support to help individuals connect with licensed healthcare providers. Omara does not provide medical care, diagnosis, or treatment. All clinical services are delivered by independent providers through third-party clinical platforms.

This Privacy Policy explains how Melius Wellness LLC (“Melius,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information through our websites and related services, including the Omara and Soren websites (collectively, the “Sites”).

Melius is a non-clinical wellness and technology company. We do not practice medicine. Clinical services (including diagnosis, prescribing, and medical decision-making) are delivered by independent licensed providers through our clinical partner(s) and their platforms (the “Clinical Partners”).

HIPAA and Clinical Partner Privacy Practices

Melius Wellness LLC is not a Covered Entity under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) for purposes of operating the Sites.

Clinical Partners, including OpenLoop Health and its affiliated Medical Groups, are Covered Entities under HIPAA and maintain their own Notice of Privacy Practices, which governs how protected health information (“PHI”) is collected, used, disclosed, and protected within their clinical portals and medical record systems.

In limited circumstances and pursuant to our Business Associate Agreement with our Clinical Partner(s), Melius may act as a Business Associate under HIPAA with respect to certain PHI that we receive or process to support operational coordination, eligibility routing, enrollment status updates, and administrative support. When acting as a Business Associate, we comply with applicable HIPAA requirements under our agreements and applicable law.

For access to medical records, amendments, accounting of disclosures, restrictions, or other HIPAA rights relating to clinical care, you must contact the applicable Clinical Partner directly in accordance with their Notice of Privacy Practices.

Health-related information submitted only through our public Sites may not constitute PHI under HIPAA but may be subject to applicable state consumer health data laws.

Key privacy points

  • We do not provide medical advice on the Sites. If you need medical advice, you should consult a licensed clinician.
  • We may ask initial eligibility questions to help route you to a Clinical Partner. More detailed medical intake, diagnosis, prescribing, and care are handled in the Clinical Partner’s portal and systems.
  • Payments for clinical services are processed through the Clinical Partner or their service providers, not by Melius (even if a payment flow starts on our Sites).
  • Our Sites use cookies and similar technologies (including analytics and advertising pixels). You can manage many of these through your browser settings and, where available, cookie tools on the Sites.
  • We may send service and marketing communications by email and SMS, subject to your choices and opt-out rights.
  • We describe consumer rights and choices below, including rights available under the Texas Data Privacy and Security Act and certain consumer health data laws.

1. Information we collect

We collect information in three main ways: (a) information you provide, (b) information collected automatically when you use the Sites, and (c) information we receive from Clinical Partners and service providers.

A. Information you provide

  • Contact details (such as name, email address, phone number).
  • Information you submit through contact forms or support requests.
  • Initial eligibility questionnaire responses (which may include health-related information).
  • Account-related information if you create an account with us (if applicable).

B. Information collected automatically
We and third parties may collect information automatically through cookies, pixels, SDKs, and similar technologies. This may include IP address, device identifiers, browser type, operating system, referring URLs, pages viewed, links clicked, time spent, and interactions with our marketing.

We may use tools such as:

  • Analytics (for example, to understand how users navigate our Sites).
  • Advertising/retargeting pixels (for example, Meta and Google) to measure and improve marketing.
  • Fraud and security monitoring tools.

C. Information received from Clinical Partners
If you proceed to clinical care, Clinical Partners and their service providers may share certain information with us, such as enrollment status, eligibility routing outcomes, appointment confirmations, and limited operational updates needed to support the non-clinical experience. Our handling of such information is governed by our agreements with those partners.

2. How we use information

  • Provide and operate the Sites and related services (including eligibility routing and support).
  • Respond to inquiries and provide customer support.
  • Send service communications (for example, confirmations, reminders, operational updates).
  • Send marketing communications where permitted and based on your preferences.
  • Understand and improve the Sites, including analytics and product research.
  • Detect, prevent, and investigate fraud, misuse, and security incidents.
  • Comply with legal obligations and enforce our terms and policies.
  • Create aggregated or de-identified information for analytics and business purposes.

We may use automated tools, analytics systems, and artificial intelligence or machine learning technologies to analyze usage patterns, improve our services, enhance operational workflows, strengthen security measures, and support quality initiatives. These tools are used in accordance with applicable privacy laws and our agreements with Clinical Partners.

3. How we share information

We may share personal information in the following circumstances:

  • With Clinical Partners and their service providers, to facilitate eligibility routing, onboarding, and delivery of clinical services.
  • With vendors and service providers who perform services for us (for example, hosting, analytics, customer support, SMS/email delivery, security, and fraud prevention).
  • With advertising and analytics partners, subject to your settings and choices.
  • With professional advisors (lawyers, accountants, auditors) as needed.
  • For legal reasons (for example, to comply with lawful requests, protect rights and safety, or respond to claims).
  • In connection with a corporate transaction (for example, a merger, financing, asset sale, or bankruptcy).

When acting as a Business Associate under HIPAA, we share PHI only as permitted under our agreements with Clinical Partners and applicable law, and solely for operational coordination, support, and other authorized purposes.

We do not sell personal information in exchange for money. We may share information for targeted advertising or similar activities as described above, which may be treated as a “sale” or “sharing” under certain state laws.

4. Cookies and similar technologies

Cookies are small text files stored on your device. We use cookies and similar technologies for essential site operations, analytics, and advertising.

  • Necessary cookies: required for core functionality and security.
  • Analytics cookies: help us understand site usage and improve performance.
  • Advertising cookies/pixels: help measure and improve marketing and may support retargeting.

How to manage cookies: You can adjust cookie settings in your browser. If the Sites provide a cookie preference tool, you can also use it. Blocking cookies may affect site functionality.

Do Not Track: Some browsers offer a “Do Not Track” signal. Our Sites may not respond to browser-based Do Not Track signals.

5. Email and SMS communications

Email
You may opt out of marketing emails at any time by using the unsubscribe link in the email. Even if you opt out of marketing emails, we may still send non-marketing messages (for example, service or support messages).

SMS/Text messages
If you opt in to receive SMS messages, you consent to receive messages at the phone number you provide. Message frequency varies. Message and data rates may apply.

You can opt out at any time by replying STOP. You can request help by replying HELP.

We do not share SMS opt-in consent data with third parties for their marketing purposes.

6. Your rights and choices

Depending on where you live, you may have rights regarding your personal information, such as the right to access, correct, delete, or obtain a copy of your information, and to opt out of certain processing (including targeted advertising).

Texas residents
If you are a Texas resident, you may have rights under the Texas Data Privacy and Security Act (TDPSA), including rights to access, correct, delete, and obtain a copy of certain personal data, and to opt out of targeted advertising and certain profiling.

How to submit a request
For rights relating to medical records or PHI maintained by a Clinical Partner (including access, correction, accounting of disclosures, or restrictions), you must submit your request directly to the applicable Clinical Partner in accordance with their Notice of Privacy Practices. Melius does not maintain the designated medical record set for clinical care.

7. Consumer health data disclosures (Washington / Nevada)

Some states (including Washington and Nevada) regulate “consumer health data” that may not be covered by HIPAA. Because our eligibility questionnaire and related site interactions may involve health-related information, we provide the disclosures below.

Categories of consumer health data we may collect

  • Health-related information you provide in eligibility questions (for example, symptoms, conditions, medications, goals).
  • Information that may identify you as seeking health services (for example, program interest or eligibility outcomes).

Purposes

  • To provide eligibility routing and support services.
  • To operate, secure, and improve the Sites.
  • For marketing and advertising, where permitted and subject to your choices and any required consent.

Sharing
We may share consumer health data with Clinical Partners, vendors, and service providers as described in Section 3. We do not share consumer health data with third parties for their own marketing unless you provide consent where required.

Your rights

8. Data retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide services, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods may vary depending on the type of data and the context.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee absolute security.

If we become aware of a security incident or data breach affecting personal information under our control, we will provide notification as required by applicable federal and state law. Where PHI is involved and we are acting as a Business Associate, breach notification procedures will follow our obligations under HIPAA and our agreements with Clinical Partners.

10. Children

Our Sites are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us at hello@omarahealth.com.

11. Updates to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version on the Sites and update the “Last Updated” date above.
